I am aware of that clause but had completely forgotten its implications here. In its purest interpretation even the SAXBE fix may have been unconstitutional. There is no such escape provision. I am anxious to hear the discussion as it unfolds. For it should, it will, and it must. Thanks for your scholarship.
But unless the Supreme court rules, the powers that be will apply the interpretation which satisfies their wishes.

This is not, apparently, the first time the issue has come up.

The Volokh conspiracy, regarding Hillary Clinton’s eligibility to serve as Secretary of State for the Obama administration.
But one in particular would be pertinent in the case of Hillary. When President Nixon wanted Sen. William Saxbe for his Attorney General, he had Congress reduce the wage, which had been increased and triggered the clause, in order to get around the restriction. The maneuver has been dubbed the
“Saxbe fix”.

I heard a radio show last night mention............
The "emoluments clause"......and I had to do some reading on it......
I am afraid this bunch is so used to ignoring the Constitution, that is will just be a small bump in the road.......it's a shame you won't hear a word on this in the Mainstream Media.......
