I did hear something about someone having the rights to it too ..which is why most restaurants sing their own birthday songs and not the popular version ...to avoid lawsuits ..LOL
I went to blue man group yesterday and they asked the audience to help celebrate someones birthday ..they said ..please read along with us ....don't sing ..and then flashed up the words ...was pretty cute!
Thanks for the birthday wishes!

I looked up the rights to Happy Birthday on the trusty website, Snopes.com. They do mention Michael Jackson, but not as the one who owns the rights.
See the article here.

Happy Birthday, Okie
Did you realize that by singing that song in public, you are now liable for royalty payments to Michael Jackson? That's right, the two little old ladies who wrote the song "Happy Birthday" sold their rights to Apple Corps (That's right: John, Paul, George and Ringo) for bugoo bucks at least 30 years ago. Apple Corps then sold the musical rights they held, in one of the most controversial rights transfers in the biz, to Michael Jackson at least 15 years ago.
