I agree. And, yes, that hospital staff obviously didn't have enough time to intervene before that client walked in the door with the dog off leash and the client with a cat not in a carrier. We can't predict people not having common sense.

T99, I understand what you're saying as far as how the law recognizes the legal aspect. THIS is what needs to change. Especially with all the frivolous law suits these days brought upon people only looking for easy money, it should be based on a case to case basis. It is in certain circumstances, but not nearly enough. Look at all the "ambulance chasing" lawyers out there. They know they have the law on their side regardless of the amount of frivolousless of the case, fault of their client, or the aftermath and outcome of the company being sued.

I have to disagree with you there T99... if they rules were posted then they should have been followed. If the owner did not follow the rules it was the owners fault. Sounds like the incident happened to fast for the staff to have a chance to stop it. I hope the hospital countersues and wins. One of the best things that's happen in a long time is the BAN on suing fast food places by people who gained weight. I hope the courts get some help from some more laws soon.

Actually

the animal hospital ALLOWED the Bull Mastiff to enter their property without being properly contained/leashed, so unless they can prove that the Bull Mastiff was trespassing, the hospital would be liable, too - IMHO.

But....the unwritten rules of litigation are "follow the money".  The hospital has more assets than the owner of the bull mastiff, therefore it's their fault.

Pecan and Passion, It really is too bad and yes, America is going gung ho on suing anybody for anything these days. Something really should be done about it. However, I think people need to really take a closer conscious look at who/what they are placing lawsuits against. Maybe some large companies such as a major airline or large insurance company may not look twice at a lawsuit. "Mom & Pop" shops are different. Not that ALL animal hospitals are "mom and pop" shops, but many are not too far off. They are small businesses and a lawsuit or huge liability insurance hike can close them down forever.

That just pisses me off.
The owner of the Bull Mastiff should be sued.  Not the animal hospital. Sigh.  America's is too gung ho to sue.
