You are in a tough position with the house because the sale can put you farther in debt than you already are! The mortgage company/bank can come after for the remaining balance after the sale! It would be so much better to have a short sale because you can negotiate a settlement! It takes 7 years for it come off the record from the date of the last payment! If you are deemed to still owe money then they can seek a judgment against you and that would be an absolute nightmare because it stays on there 7 years from the date it is paid off! I think the banks/mortgage companies are getting away with murder in this country on the damn foreclosures! They got a bailout but they aren't helping anyone! I had a go round with my previous company because they refuse to report it as agreed and they had the audacity to tell me there were consequences for what happened notwithstanding that I demonstrated hardship, a hardship they induced due to their robo-signing and ARM that was not clearly represented in the loan itself! So, I asked them who really is paying because they got a Gov't bailout, and a slap on the hand with their settlement with the Gov't to pay those affect a mere $1,500 to $2,000 depending upon who qualifies and they have 3 years to pay! Not one of us who lost their home got any kind of deal like they did! And worse, you have lost yours beyond the date to qualify for anything! California is one of the hardest hit states and they continue to foreclose and not modify loans! The market will only bear so much but they could care less! For me it is nothing but hypocrisy and they creates the damn mess to begin with! I just watched a video on the housing market and they think it has bottomed out, but don't look for things to increase dramatically they said. However, for me, there is good news because prices with not increase and time is on my side! But, I have put in my 3 years of waiting to get out of the mess they created! Also, another article that I read said that it takes 7 years for one's credit to get back to the score they had prior to a short sale or foreclosure! Just garbage that they can have so much control on the report by putting whatever they want on it at any given time! They say it is the law but it is not, the law states how they much report what they report not what has to be reported! So, I found several discrepancies on my report and have decided to dispute them, and I am going to dispute things that are correct to get verification! I plan to send a dispute to them each week, then contest their findings in an effort to wear them out to take it off my record just to get rid of me! I may not win it, or they may just battle me but I will make their lives as miserable as I can in the process! It is cheaper to do it this way than hiring a law firm because the cheapest I could find was $99 a month without a guarantee that anything positive could result. A mere four letters is less than $2.00 so the savings is indeed worth doing my own dirty work so to speak! I do hope you are not held accountable for the balance after the auction! It could be devastating! sam Sorry about the length of my comment but it just riles me to no end that the rogues are getting away with it and we are left holding the bag for their deceitful practices! The Gov't went with a settlement because it is tough to get a judgement on them yet they hold every consumer accountable! UGH!
