Re: The Congress and Laws
The Constitution limits the Congress to making laws which are "necessary and proper" for implementing the specific powers granted to Congress under that same Constitution. The army and the local militia (disciplined and commanded by officers appointed by the state) are used to protect the United States from invasions. At no point in the Constitution are borders "protected" from anything other than armed assault. Even the infamous and expired slave trade protection clause prohibiting Congress from limiting the importation and migration of persons until 1808 doesn't give Congress the power to do so in the present day. And migration would also apply to anyone moving from state to state.

Very interesting Carl... but isn't Congress the one that makes and institutes the laws? Is there in the constitution of the US a specific prohibition of immigration laws being created? I just don't know enough about it to argue against what you just said but it just makes sense that eventually any country has to guard its borders to protect its way of life... specially in today's world.
