       Since you already intend to move, and it is summertime, the school year is just beginning, (If a student must transfer, it should be done early in the term) I would ask a lawyer about your situation. What are the homeowner's obligations to maintain your health and safety, do the conditions of the house legally entitle you to break your lease, and move out immediately. The first consultation is free, and you can learn much in one visit. County courthouses have hand-out booklets for the public that will tell you everyone's obligations to the other party, the lawyer can look at your lease and point things out about that specific rental agreement, advise about legal questions, and you may learn that you can dispense with the lawyer, and move out (Let the landlord know that you are moving, why, in writing, keep a copy, and send it registered mail!), and let the landlord decide if he should pursue further, what he may already know is a losing case.

What a drag! I have had my problems with my rental management company! They have to fix my front window! I do what I can myself, it's faster! I hope you get resolution soon! sam

Our lease is not up until July 2010.  We have decided that it's time too move on as close to July as possible.

      A yard of concrete poured into the hole would inexpensively solve the problem, at least temporarily. Water flow problems will still have to be addressed to prevent a re-occurrence of the erosion, probably by contracting out an expensive landscaping project. Your landlord may be unwilling or unable to afford this. If nothing is done to correct this, your best option is to look for better housing and a better or wealthier landlord.
      There are legal ways to enforce your rights as a renter, but forcing a landlord to accomodate your concerns, will ruin any possible rapport you can have with him, forever. Better to move voluntarily, because your days in that house will be numbered, from that day onward, whether you know it yet, or not.
      For many years, I was a landlord, and have spent many sleepless nights worrying that a water pump might burn out, a furnace will need replacing, a septic field will have to be replaced, etc. because if such a calamity occured, I could not afford to fix it. If a renter starts withholding rent, of brings a lawyer into it, things will deteriorate quickly and irrevocably, between owner and tennant.
      If a landloard wants to get rid of a renter, all that he has to do, is suddenly start enforcing the rental aggreement STRICTLY.
      Never, EVER piss off your landlord! This is the eleventh commandment!
