don't watch their children.
lots of chokings in the ER's from many sources -- can't blame anyone but themselves.

I understand you can not watch your children every second of the day, and that is why my three year old can get into as much as he can.  But you also do not leave your 20 month old alone with choking hazards.  I want to know why the kid had access to those toys in the first place, since by all logic and common sense he should never have been allowed to play with them, with or without parents around.

When both of my sons were that young there were no toys or such left out where they could get them that could be choking hazards.  Anything the kid might swallow should be picked up and put out of reach, it is real easy to do in any room if you just take moment to make sure you put you child down in a safe area.

I do agree that not all toy law suits are frivolously, just most of them.  I would say 99% of the time it is really not he toy company at fault, just someone being stupid with the toy and not wanting to take the blame for their own actions.

This particular case is frivolous ...

However, not all toy-related wrongful death actions are created equal.  Besides, what's so wrong with the parents making a "shameless money grab", anyway?

P.S. Oh, and no one can watch their children every single second.

True!
Frivolous suits fill the courts while essential ones are dismissed.  There is too much child neglect these days.  Parents refuse to discipline children, and allow them to get victimized when in fact common sense and personal responsibility of their children would prevent many things from happening.  Good expression!!

kooka, this is an excellent post! I am sure you already know this, but

I just had to tell you.

There have always been things, toys, nuts, even dirt and rocks around when children play, it is our responsibility as parents to keep them from putting them in their mouths. I cannot imagine one of my children having had the opportunity to do something like this, especially as a toddler. One can never, never I say, let them out of your sight, lest something like this happen.

Hopefully, common sense will cause a potential judge or jury in this case to lay the blame where it belongs!
