Get your own legal representation that will carry out your mother's wishes and represent her best interest and rights according to the law.  They will present all legal aspects and will eventually contact your brother's attorney.  Find someone who you trust and sincerely believe will do the job.  Let your lawyer speak for your mother...

If your mother's wishes are not being carried out, she has the power to change her desires and/or person to fulfill them at anytime.  Her happiness is what counts nothing else should matter.  You can submit any legal question to this forum below and here are some important resources that will help you take care of your mother's affairs.

Yes that is what I have been thinking, but I don't want the financial part of it just the part that helps make the decision where she is to live and he wants her in a home and she doesn't want to be in one.  That is why she was rushed off to the hospital because she was so miserable where she was.

I am Not an Attorney, Yet I Think Your Mom/You Will Need Original Attorney

If your Mom is still able to make decisions on her own, I think the original attorney will need to file papers in order to change the current power of attorney. I think the original one is legally binding, since she had to agree or was legally determined incompetent to act on her own behalf.

I do not think any notarized document will supercede one that is currently operating, regardless to her desires.  Please contact the attorney.  Is there a way that you and your brother can discuss and come to an agreement?  That really would be the best way.  Otherwise, it may appear as though there is competition for her assets as opposed to doing what is in her best interest.  This is just my opinion.  Best to you in this difficult situation.
