Something like this comes up and I go into panic mode, high anxiety, and want to run and hide. I am pretty sure he has made no money from it at all, but if one copy sells, I want the money coming back to me. I do need a representative one way or another, because talking to him directly would be a bad scene.
I do appreciate your laying it out in a sane voice, which I haven't got in this regard. I have spoken to my publisher/editor at Magalomaniac, and he also has given me some information.
It is indeed likely he has done the same to other writers. Charlie, in fact, had a story in this guy's anthology, so he might also have an interest in this.

Document dates, times, emails, etc. Collect the info in writing.
Talk to the dude, via email if possible, ask why he didn't get your permission and when or if he plans to compensate you for your intellectual property. You may not have $$ for a lawyer now, but it may be you can get one to take the case on contingency - especially since it's highly likely he's done the same thing to other writers. The thing is to prove damages in that he's made money from your work without paying you... Don't know why I'm telling you this, you no doubt already know all of it, plus the copyright process, etc.
