It's a fine line between wanting to get some ACK-tion on a legitimate grievance and getting nada, zip, the bum's rush, and ACK-ting out so much you wake the neighbors.

Two parts to the law. Mens rhea-mental intent; actus rhea=the act.
Culpability is weighed and measure, measure for measure, by a judge to determine did the defendant intend to commit an infraction. Dave did not intend to not comply wth the Code of Conduct, complied with cease and desist email. No intent. Does not meet the mens rhea criteria.
Therefore, even if the act itself were a crime, for the sake of argument, let's say egregious act of spam, then the act was purely unintentional. There's nothing illegal about it.
He has offered every olive branch, it were the better part of valor to admit an embarrassment, eat a little crow, Save face. Dave comes back, we all win. end of story
