I think the charge will stand, or should stand.  The original problem was an eviction, which means Meyer was not meeting the terms of his lease.  Meyer should have taken care of his problems with the landlord, long before the landlord had to resort to eviction proceedings.  Meyer failed to do that, so he brought the eviction upon himself.  When the constable showed up, to do his duty of eviction,  Meyer had no moral or legal reason to point a gun at the constable.  However, the constable had a good reason to defend himself against Meyer,  who was pointing a gun at him and threatening his life.  So, with all things considered,  Meyer is indeed the most responsible person for the death of his child.

The father did not shoot the girl. Seems like an unjust decision.

My guess is that the charges will not stand. The father was incredibly irresponsible for revealing a firearm in that situation.
