Of course it's rather insane, this is the Theatre of the (Almost) Absurd. lol. What kept us from threatening that my daughter would take the stand is that we were told in order to really collect, she would have to show permanent damage was done to her. Since her foot and hip had healed, we were told it would have to be 'permanent psychological damage' that she suffered, and she would be subjected to a battery of tests to be 'certified damaged' (my words). I didn't want to burden my child with that stigma after having worked so hard for just the opposite result. Of course, in retrospect, we would have tried another approach with a different attorney. Sorry you also know the drill. It does suck.

No, not dull. Most people have had unpleasant experiences with attorneys. Funny, why is that?

He was one of the good guys, then, right? Yes, this dodo took 33% he claimed. He may have taken 1,000,033% for all I know. LOL.

Your poor mother. How outrageous! No, my daughter's foot healed and she is fine with it. Thank God.

wow... this story is insane!!!  So glad your daughter was okay in the end but I'm sorry you didn't get damages paid to you.  Your lawyer sucked... they should have easily been able to settle out of court for more money, (using only the threat that your daughter would take the stand).  It seems like a very clear cut case.  

But this is the problem with lawsuits... the damaged party is usually too damaged to even consider being torn apart on a witness stand... and by the time they have the strength to sue, it's too late.  (yep, speaking from personal experience)

Things were never dull immediately after those events...I have had a few unpleasant experiences with attorneys over the years...

Big Corp has big lawyers. I worked for a small town attorney

once - he'd been a junior attorney for an insurance company, learned to hate their way of imposing small, unfair settlements on injured people. So he took up the cause of getting them equity. He only took a 20% fee, most attorneys took 33% or more. I liked his philosophy.

No the only thing I can think of is when one of my mother's geese, well the gander pecked a woman's leg. I tried to get redress for her from the insurance. The agent said well one is allowed the first bite. Also do not give the victim anything or that will admit that you are in the wrong. I guess one has to be hard to screw money out of insurance firms. I just wonder does your daughter ever feel a bit of discomfort in the foot?
