I agree with Kabu...just go ahead and move if the house is livable. You will have peace of mind and your own place to not have to deal with his erratic behavior.

I would move in if it were me ASAP and just leave the divorce and the odds and ends of stuff to your lawyer. Perhaps you can be in before some of the work is finished. You and the doggies need your new home.
