I don't think the court remark is the point of any of the criticism......
He is obviously stressing the importance of the Legislative branch's roll to spread the wealth around and the use of that power to achieve it.

.....based on the interpretation given here......public schools are socialistic, police, fire departments and the post office too.

 Obama was lamenting that the great tragedy of the civil right movement was that it tried to center itself around the power of the courts instead of focusing on the "community organizing and activities on the ground that are able to put together the coalitions of power through wich you can bring about the real redistributive change through pressure on the legislative branch ........kind of like his years with Acorn and the structure of his campaign.....we are seeing his 2001 dream of redistribution being made real before our eyes.....
