Even if you want to let it lay, that'll evap if you don't write it up.
If they decide to toss you a crust or even a landslide, they can just as readily decide to stop or ask for it back.
Maybe a lawyer buddy will write a nice impressive letter for you on letterhead and send it certified delivery expressing your wishes and conditions to them? Amazing how much fancy paper and a "JD" after the name can whip people's heads around and think about how much time they'd lose to a court deal, even small claims.

I hate stupid people..
and this publisher sounds stupid.
I probably wouldn's sue, but instead have a 'talk' and see if we can't re-negotiate the terms...

Apparently this publisher forgot to read the contract; but don't sue. It could cost a lot more in money and stress than revenue from your book sales.
