I agree with the posts already up,

In order to get sole legal custody you have to prove that he is a danger to the child or something along those lines. You may be able to get sole physical custody, but if he wants joint, he will probably get joint. He shouldn't be able to wrestle physical custody from you, unless he can show you as unfit, in some way. It is a touchy thing in with the law right now, the law has traditionally gone against the father and has been showing a growing trend the other way. We have learned that the father needs to play a role and being with the mother isn't always the best just because she is the mother. Just be careful!

It might not be that easy....
I do  not know where you are from. But it might not be that easy, the father has more rights than you think and courts are recognizing those rights more often than not. If the father is not a danger to the child and appears stable the judge most likely will rule that he can have visitation. It might not be what you want, but the court has only the law and legal opinion in sight. You might want to meet with a mediator and see if you can compromise a custody agreement if your lawyer indicates that the father might obtain visitation rights. The legal system has made some really bad decisions in custody cases lately, so don't be suprised. Also keep in mind, if the court requires any pyschological evaluations done you have to pay for them. That can be anywhere from $600 to $2000.00.  The legal system can be expensive and shocking.
