I don't think they are going to take that step though.
The Dems are not going to waste political capital on this guy. Plus, I have just read where the search for papers about the Princeton thing found nothing. So I think the Dems will retreat on this one and try something else to get over on the Republicans, such as the Abramoff affair.

Oh but they can!
Strictly interpreting the Constitution, there is no mention that every nominee is entitled to an up or down vote. The Dem's could filibuster Scalito.
